Rudzik Excavating—First Amendment–retaliation victim—files new complaint against Mahoning County

Youngstown, OH – Rudzik Excavating, which in 2024 filed a First Amendment–retaliation lawsuit against Mahoning County and its commissioners, has filed a new civil complaint in Mahoning County Court of Common Pleas against the County. The prior suit stemmed from allegations that the County commissioners retaliated against the company for publicly criticizing the County's approach to projects.

The new suit seeks a declaratory judgment by the court that the County did not actually have contracts with the company that would entitle the county to seek the company's bid bonds.
