Tamir Rice family asks prosecutors for aggravated-murder charges against officers, noting that statue does not require prior calculation or design where the victim is under the age of 13

Thursday, September 10, 2015

Counsel for the family of Tamir Rice, the 12-year-old boy shot by Cleveland police on November 22, 2014, have requested that the prosecutor seek a charge of aggravated murder. As explained in the linked letter to the prosecutor JSA-Letter-to-McGinty-Re-Aggravated-Murder-9-10-15, Ohio's aggravated-murder statute removes the element of "prior calculation and design" where the victim is under 13 years of age. All that is required is a purpose to kill.
